Frequently asked questions

The legislator has defined which work counts as "cosmetic repairs" (Schönheitsreparaturen) in § 28 Abs. 4 II. BV (Second Calculation Ordinance):
· Wallpapering
· Painting or whitewashing walls and ceilings
· Painting floors
· Painting radiators, including heating pipes
· Painting interior doors
· Painting exterior doors and windows from the inside

Beyond that, only the preparatory work necessary for the tasks listed above counts as cosmetic repairs. If you have to paint a wall, for example, filling any existing drill holes is part of the job. Only then is the work considered properly done, even though filling drill holes is not explicitly mentioned in the law. Any other maintenance work does not count as cosmetic repairs!

§ 535 Abs. 1 and § 538 BGB (German Civil Code) stipulate that, as a rule, the landlord is responsible for carrying out cosmetic repairs. However, the rental agreement can also stipulate that the tenant must carry out repairs to remove signs of wear and tear. These obligations are usually set out in a clause headed "cosmetic repairs" (Schönheitsreparaturen). But these clauses often contain invalid provisions.
