Frequently asked questions

The precondition for a reduction in rent is that the tenant has not caused the defect himself and that the defect was not known at the time of conclusion of the rental agreement (§ 536 para. 1 BGB). Frequently occurring defects for which you can claim a rent reduction are, for example

  1. Mildew
  2. Humidity
  3. Heating failure
  4. Insufficient cold or hot water supply
  5. Noise
  6. Vermin
  7. Wrong living space in the rental contract
  8. Water damage
  9. Defective lift
  10. Impairments due to construction sites

Depending on the defect, the tenant can demand different rent reductions. Basically, the amount of the permissible rent reduction depends on how much the defect affects life in the apartment.

Unfortunately, it is not possible to say in general terms which deficiency reduces the rent by how many percent. Although there are guidelines for, for example, noise protection, heating the apartment or nuisance from cigarette smoke, in the end the individual circumstances of each case are decisive for the exact amount of the rent reduction. However, the rent reduction always refers to the gross rent, i.e. including all additional costs.

Important: In order to avoid the risk of termination, for example, if it turns out that the rent reduction was too high or unjustified, you should pay the full rent subject to recovery. To be on the safe side, have your case checked legally.

As a tenant, you have the right in the event of a rental deficiency to have the landlord remedy the deficiency immediately and at his own expense. In addition, you may be entitled to a rent reduction for the period during which the defect existed.

Important: As a tenant, you have the obligation to notify the landlord of the defect. The notification of defects should always be made in writing. You should describe the defect very precisely or, if necessary, have it verified by an expert so that the landlord can rectify the defect. The legislator prescribes that a correct notice of defect to the landlord must be made "immediately". If the submission is delayed, you as a tenant may be deprived of the right to a rent reduction. A rent reduction is therefore not possible retroactively. Whoever continues to pay the rent in full without reservation despite the defects cannot claim anything back later. To prevent this, you should inform your landlord as soon as possible after the occurrence of defects.
